PurposeThis section is intended to ensure that development and clear-cutting activities complywith the tree protection standards in this <strong>Ordinance</strong>.B. Applicability(1) In GeneralExcept for development exempted in accordance with sub-section (2) below, aclear-cutting permit is required before any clear-cutting or significant landdisturbingactivities. For the purposes of this sub-section, “significant landdisturbingactivities” shall include but not be limited to deposition or removalof fill, grading or grubbing of a site, or trenching.(2) ExemptionsThe following activities are exempt from the requirements of this section:(a)(b)(c)(d)(e)(f)(g)(h)(i)The removal of dead or naturally fallen trees;The removal of diseased trees posing a threat to adjacent trees;The selective and limited removal of trees or vegetation necessary toobtain clear visibility within sight distance triangles;Removal of trees on developed single-family residential lots or lotswithin a single-family residential subdivision platted prior to January 1,2013;Land-disturbing activities and tree removal in accordance with a siteplan, preliminary plat, or building permit approved after January 1,2013;Removal of trees as necessary to maintain safe operations at the<strong>Currituck</strong> <strong>County</strong> Airport;Land-disturbing activities and tree removal on unbuildable lands;The removal of vegetation by public or private agencies within thelines of any right-of-way, easement, or other county-owned lands asmay be necessary to ensure public safety; andLand disturbing activities undertaken on land under agricultural,horticultural, or forest production and taxed at present-use value inaccordance with Sections 105-277.2 through 277.7 of the NorthCarolina General Statutes.C.
