Chapter 5: <strong>Development</strong> StandardsSECTION 5.4: EXTERIOR LIGHTINGSubsection 5.4.3: Lighting PlanC. Existing <strong>Development</strong>Compliance with these standards, to the maximum extent practicable, shall also applyto redevelopment of an existing structure, building, or use when it is expanded,enlarged, or otherwise increased in intensity equivalent to or beyond 50 percent.D. ExemptionsThe following is exempted from the exterior lighting standards of this section:(1) FAA-mandated lighting associated with a utility tower or airport;(2) Lighting associated with navigational beacons, the United States flag, NorthCarolina flag, or <strong>Currituck</strong> <strong>County</strong> flag;5.4.3. Lighting Plan(3) Holiday lighting during the months of November, December, and January,provided the lighting does not create unsafe glare on street rights-of-way;(4) battery-powered emergency lighting; and(5) Architectural lighting of 40 watts or less.To ensure compliance with the standards of this section, a lighting plan demonstrating howexterior lighting will comply with the standards of this section shall be included as part of anyapplication for site plan, planned development master plan, subdivision, zoning compliancepermit, or temporary use permit, as appropriate.5.4.4. Prohibited LightingThe following lighting is prohibited:A. Light fixtures that imitate an official highway or traffic control light or sign;B. Light fixtures in the direct line of vision with any traffic control light or sign;C. Light fixtures that have a flashing or intermittent pattern of illumination, except fortime and temperature displays;D. Privately-owned light fixtures located in the public right-of-way; orE. Searchlights, except when used by Federal, State or local authorities.5.4.5. Street LightingA. Private streets, public streets dedicated to the North Carolina Department ofTransportation, sidewalks, and other common areas or facilities in developments maybe illuminated to ensure the security of land and the safety of persons using suchroads, sidewalks, and other common areas or facilities. When provided, illuminationshall be in accordance with a plan designed by the utility company.B. All street lights shall be located inside full cut-off fixtures mounted on non-corrosivepoles served by underground wiring.C. The light structure and light color of street lights shall be consistent throughout thesubdivision.D. Illumination standards must be met prior to final plat approval (see Section 2.4.8) orprior to occupancy, when final plat approval is not required.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE5.40
