Chapter 4: Use StandardsSECTION 4.4: TEMPORARY USE STANDARDSSubsection 4.4.6: Specific Regulations for Certain Temporary Uses and Structures(c)(d)(e)(f)(g)(h)Temporary tents may only be placed on lot that contains a permanentprinciple structure and a minimum lot area of at least 10,000 squarefeet.The tent shall not exceed the total square footage of the existingprinciple structure.The maximum building coverage, including principle structures,accessory structures, and the temporary tent shall not exceed themaximum lot coverage allowed in the zoning district by more than 10percent.Temporary tents shall be setback not less than ten feet from any lotline and 20 feet from any adjacent street right-of-way.Tents shall not be located in any easement, existing or future right-ofway,vehicular access area, required vehicular parking space, requiredlandscaping area, sight triangle, septic area, or other similar area.Temporary tents shall be maintained in good condition, and adequatelybraced and anchored to prevent weather related collapse.I. Special Events(1) Applicability(a)(b)GeneralThe procedures and standards of this subsection shall apply to allspecial events (including but not limited to sporting events, culturalevents, musical events, charitable events, celebrations, festivals, fairs,carnivals, circuses, and communal camping) held on private propertywithin the county, unless exempted in accordance with Section4.4.6.I.1.C, Exemptions.Temporary Use Permit for Special Event Required(i)(ii)All special events subject to this subsection shall have atemporary use permit for a special event reviewed andapproved or approved with conditions by the PlanningDirector in accordance with Section 2.4.11, Temporary UsePermit, before conducting the special event.The Planning Director may require review and approval fromother county officials, such as the sheriff or fire marshal, asappropriate.(c)ExemptionsThe following events or activities are exempt from the standards ofthis subsection (i.e., may occur without a temporary use permit for aspecial event). Such activities are subject to all other applicableprocedures and standards of this <strong>Ordinance</strong>.(i)On Grounds of Private ResidenceSpecial events or activities occurring within, or on the groundsof, a private residence or on the common areas of atownhouse or multi-family residential development.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.71
