Chapter 4: Use StandardsSECTION 4.2: USE-SPECIFIC STANDARDSSubsection 4.2.2: Residential Uses(5) Dwellings, Multi-Family and TownhouseMulti-family and townhouse dwellings shall comply with the multi-family designstandards in Section 5.7, the community compatibility standards in Section5.10 (as appropriate), and the following standards:(a)(b)(c)(d)No accessory structure shall be less than ten feet from anotherstructure.No improved recreation area shall be located within required exteriorsetbacks or within 20 feet of any dwelling unit.No individual building shall exceed a length of 250 feet.A townhouse building shall contain at least three but no more than sixside-by-side dwelling units.(6) Dwelling, Upper Story ResidentialUpper story residential dwelling units shall occupy the second or higher floorof a building with a nonresidential use on the ground floor.B. Group Living(1) DormitoriesAll dormitories shall be accessory to an educational facility located on thesame site or campus, and house only persons who are students at theeducational facility.(2) Family Care HomesFamily care homes are residential uses and shall comply with the followingstandards:(a)(b)(c)(d)No more than six residents other than the homeowner and thehomeowner’s immediate family may occupy a family care home.A family care home shall be licensed with the NC Department ofHealth and Human Services Division of Facility Services beforeoperating.No family care home may be located within a one-half mile radius ofany other family care home.Only incidental and occasional medical care may be provided in afamily care home.(3) Rooming or Boarding HouseA rooming or boarding house shall comply with the following standards:(a)(b)(c)Rooms may be rented to a maximum of five unrelated persons at anyone time;The owner shall maintain the house as a primary residence;Sleeping rooms in a rooming house shall:(i)(ii)Not include individual kitchen facilities; andBe accessed by a common room or hallway, and shall not haveindividual access to the outside (except for emergency exits).CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.13
