Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.15: Administrative Adjustment(b)base flood elevation (BFE) and the elevation to which the structure isto be built and that such construction below the BFE increases risks tolife and property, and that the issuance of a variance to construct astructure below the BFE will result in increased premium rates forflood insurance up to $25 per $100 of insurance coverage.Such notification shall be maintained with the record of the varianceaction.(6) RecordsUpon request, the Planning Director shall report any flood damage preventionvariance approvals to the Federal Emergency Management Agency and theState of North Carolina.G. Effect of Development ApprovalApproval of a variance authorizes only the particular regulatory relief approved. Itdoes not exempt the applicant from the responsibility to obtain all other approvalsrequired by this Ordinance and any other applicable laws, and does not indicate thatthe development for which the variance is granted should receive other developmentpermits or approvals under this Ordinance unless the relevant and applicable portionsof this Ordinance or any other applicable laws are met.H. Amendment of Development ApprovalApplicable (see Section 2.3.14).I. Expiration of Development ApprovalUnless it expires in accordance with Section 2.3.15, Expiration of a DevelopmentApproval, a variance, including any conditions of approval, shall run with the land, shallbe binding on the landowners and their successors and assigns, and shall not beaffected by a change in ownership.2.4.15. Administrative AdjustmentA. PurposeThe purpose of this section is to provide an administrative mechanism for allowingminor variations, or adjustments, to certain numerical standards (i.e., setbacks) of thezoning provisions based on specific standards, with the intent of providing relief whereapplication of a standard creates practical difficulties in allowing development thatotherwise advances the purposes served by the standards and is compatible with thearea.B. Timing(1) An administrative adjustment may be requested either as a stand-aloneapplication or in conjunction with other application(s).(2) If an administrative adjustment application is submitted in conjunction withanother application, it shall be reviewed and decided prior to the otherapplication. (For example, if an administrative adjustment application issubmitted in conjunction with a site plan application (because theadministrative adjustment is needed to achieve the plan for development in thesite plan), the administrative adjustment application shall be reviewed anddecided upon prior to review of the site plan application.)CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.65
