Chapter 2: AdministrationSECTION 2.3: STANDARD PROCEDURESSubsection 2.3.6: Public Hearing Scheduling and Public Notification(1) Schedule and ensure any required notice of public hearing on the application(if appropriate) in accordance with Section 2.3.6, Public Hearing Schedulingand Public Notification;(2) Transmit the application, related materials, and the staff report to theappropriate advisory or decision-making body;(3) Transmit a copy of the staff report to the applicant; and(4) Make the application, related materials, and the staff report available forexamination by the public in the Planning and Community DevelopmentDepartment during normal business hours, and make copies of such materialsavailable at a reasonable cost.D. Applications Subject to Decision by Planning Director or Technical ReviewCommittee(1) DecisionIf an application is subject to staff review and a final decision by the PlanningDirector or Technical Review Committee, as appropriate, the PlanningDirector or Technical Review Committee shall approve, approve subject toconditions, or disapprove the application, based on the review standards setforth in Section 2.4, Specific Review Procedures, for the particular type ofapplication.(2) Conditions of ApprovalConditions of approval shall be limited to those deemed necessary to ensurecompliance with the standards of this Ordinance. They shall be related in bothtype and amount to the anticipated impacts of the proposed development onthe public and surrounding development. All conditions of approval shall beexpressly set forth in the development permit or approval.2.3.6. Public Hearing Scheduling and Public NotificationA. Public Hearing Scheduling(1) Application to be Scheduled for MeetingWhen a development application is subject to a public hearing, the PlanningDirector shall ensure that the public hearing on the application is scheduledfor a regularly scheduled meeting or a meeting specially called for that purposeby the advisory or decision-making body reviewing the application.(2) TimingA required public hearing on the application shall be scheduled so there issufficient time for a staff report to be prepared and for the public notificationrequirements to be satisfied under state law.(3) Required Public HearingsTable 2.3.6.A, Required Public Hearings, identifies the advisory and decision–making bodies responsible for conducting a public hearing on a developmentapplication, where a public hearing is required, and the type of hearing(legislative public hearing or quasi-judicial public hearing) to be conducted.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.18
