Chapter 4: Use StandardsSECTION 4.2: USE-SPECIFIC STANDARDSSubsection 4.2.5: Industrial Uses(b)(ii)With the approval of the Planning Director, an expansion ofan existing mine operation not to exceed 40 percent of thetotal site area can be mined.(iii) In accordance with Section 2.3.14, the Board ofCommissioners can approve an expansion of an existing mineoperation not to exceed 50 percent of the total site area.Addition Standards(i)(ii)(iii)(iv)(v)The existing mine has an active use permit and State permit.The existing mine has been in operation for a period of no lessthan five years.The existing mine has maintained compliance with allapplicable state and local permit regulations for the past fiveyears of operation.The cumulative total of the mine’s excavation area, includingthe requested expansion, shall not exceed 50 percent of thetotal site area. All on-site CAMA and US Army Corps ofEngineers designated wetlands and surface waters shall not beincluded in the total site area calculation.All state mining permit modifications shall be obtained prior toany expansion activities being performed.(15) ExpirationThe use permit shall be valid for a period of ten years from the date it isgranted or for a shorter duration as deemed appropriate by the Board ofCommissioners. In the event the property owner desires to continue themining operation thereafter, he shall again petition the Board ofCommissioners for a new permit.(16) Extension of Expiration Time PeriodThe Planning Director may, upon receiving a written request for extension,grant an extension not to exceed ten years provided the existing mine hasmaintained compliance with all applicable state and local regulations.B. Industrial Services(1) CrabsheddingCrabshedding uses located within a residential zoning district shall comply withthe following standards:(a)General Standards(i)(ii)(iii)All phases of the operation must be conducted not less than10 feet from the property line and not less than 50 feet fromany adjacent dwelling;No odor, fumes, excessive noise, or traffic shall be allowed;On-premise freezing, packing and preparation for shipping isallowed;CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.38
