Chapter 6: Subdivision and Infrastructure StandardsSECTION 6.2: REQUIRED INFRASTRUCTURESubsection 6.2.1: Street Standardsconveyance of 51 percent of the lots in the subdivision may be reviewed bythe Board of Commissioners. The Board of Commissioners, at the request ofthe subdivider, shall waive the requirement upon a finding that the associationhas sufficient financial capacity to assume maintenance responsibility forcommon areas, common facilities, and private infrastructure.G. Failure to Maintain is a ViolationFailure to maintain common areas, common features, or infrastructure is a violation ofthis <strong>Ordinance</strong> and is subject to the penalties and remedies in Chapter 9: Enforcement.6.2. REQUIRED INFRASTRUCTUREUnless exempted, all development in the county shall comply with the standards in thissection.6.2.1. Street StandardsA. ApplicabilityUnless exempted in accordance with Section 6.2.1.B, Exemptions, the street standardsshall apply to all streets serving three or more lots.B. Exemptions(1) Private Access Streets(a) Streets within a family subdivision or serving a subdivision of two orfewer lots are exempted from the standards in this section, providedthey are configured in accordance with Figure 6.2.1.B, Private AccessStreet Standards, and Section 6.2.1.C.4, Connection with State Streets.(b) All subdivision plats served by private access streets shall bear thefollowing notation:“Private access streets do not meet the NCDOT’s minimum standardsfor the assumption of maintenance. <strong>Currituck</strong> <strong>County</strong> does notconstruct or maintain streets. Further subdivision of any lot shown onthis plat may be prohibited by the <strong>Currituck</strong> <strong>County</strong> UDO unless theprivate access street is improved consistent with minimum NCDOTstandards.”CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE6.6
