Chapter 7: Environmental ProtectionSECTION 7.2: TREE PROTECTIONSubsection 7.2.3: Protection of Heritage TreesFigure 7.2.3, Tree Protection ZonesC. Standards for ProtectionA heritage tree shall not be removed, except in accordance with Section 7.2.3.D,Removal of a Heritage Tree. In addition, heritage trees shall have the followingprotections, whether located on public or private land:(1) Cutting, Removal, or Harm ProhibitedHeritage trees shall not be cut, removed, pushed over, killed, or otherwiseharmed.(2) Soil Compaction ProhibitedThe area within the dripline of any heritage tree shall not be subject to soilcompaction greater than 25 percent of the total area within the dripline, orwithin 12 feet of the tree trunk.(3) Encroachment(a)(b)Buildings or other structures shall not encroach within a designatedtree protection zone.Impervious surfaces may encroach into a dripline in the followingamounts:(i)(ii)A maximum of 25 percent of the dripline associated with aheritage tree, but no closer than 12 feet from the trunk of aheritage tree; andA maximum of 50 percent of the dripline associated with anexisting tree (other than a heritage tree) designated forretention, but no closer than six feet from a tree’s trunk.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE7.9
