Chapter 4: Use StandardsSECTION 4.2: USE-SPECIFIC STANDARDSSubsection 4.2.3: Institutional Uses(A) The height of the replacement tower shall not exceed110 percent of the height of the replaced tower.(B) The replacement tower shall be located within 100feet of the replaced tower, unless the PlanningDirector determines that a farther distance furthersthe purpose and intent of this <strong>Ordinance</strong>.(C) The replacement tower shall comply with all thestandards of this section (including setbacks).(e)(f)(xiii) Nonconforming Telecommunications TowersNonconforming telecommunications towers shall be allowedto remain and be maintained in accordance with the standardsin Chapter 8: Nonconformities. Additional equipment may beadded to the tower provided that such additions do notincrease the degree of nonconformity.(xiv) Discontinued UseIf a telecommunications tower is not used for a period of sixconsecutive months, the Planning Director may send thetower owner notice indicating that the tower must beremoved within 90 days from the date of notice.Collocation of Antennas on Existing TowersAntennas may be collocated on existing towers if they comply withthe following standards:(i)(ii)(iii)It is demonstrated the tower can accept the additionalstructural loading created by the collocation.Any modification of an existing tower to accommodate thecollocation of additional antenna shall comply with the heightlimit established for freestanding telecommunications towersin Section 4.2.3.H.2.d.ii, Height.Antennas and associated equipment shall comply with thesafety, lighting, interference, and regulatory compliancestandards for telecommunications towers included within thissubsection.Placement of Antennas on an Existing BuildingsAn antenna may be attached to any business or multi-family residentialbuilding in accordance with the following standards:(i)(ii)HeightThe antenna shall not extend above a height 20 percent higherthan the highest point of the building or structure.Other StandardsAntennas and associated equipment shall comply with thesafety, lighting, interference, and regulatory compliancestandards for telecommunications towers included within thissub-section.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.23
