Chapter 4: Use StandardsSECTION 4.3: ACCESSORY USE STANDARDSSubsection 4.3.1: Purpose4.3. ACCESSORY USE STANDARDS4.3.1. PurposeThis section authorizes the establishment of accessory uses that are incidental and customarilysubordinate to principal uses. The purpose of this section is to allow a broad range ofaccessory uses, so long as such uses are located on the same site as the principal use, and solong as they comply with the standards set forth in this section in order to reduce potentiallyadverse impacts on surrounding lands.4.3.2. General Standards and LimitationsA. Compliance with Ordinance RequirementsAll accessory uses and accessory structures shall conform to the applicablerequirements of this Ordinance, including the district standards in Chapter 3: ZoningDistricts, the use regulations in Chapter 4: Use Standards, the development standardsin Chapter 5: Development Standards, and the environmental protection standards inChapter 7: Environmental Protection. The provisions of this section establishadditional standards and restrictions for particular accessory uses and structures.B. General StandardsAll accessory uses and accessory structures shall meet the following standards:(1) Directly serve the principal use or structure;(2) Be customarily accessory and clearly incidental and subordinate to theprincipal use and structure;(3) Be subordinate in area, extent, and purpose to the principal use or structure;(4) Accessory uses shall not exceed 25 percent of the heated floor or buildablearea of the principal use, except where otherwise allowed by this Ordinance;(5) Be owned or operated by the same person as the principal use or structure(except that vending machines, automated teller machines, and similar featuresare exempted from this requirement);(6) Be located on the same lot as the principal use or structure;(7) Together with the principal use or structure, not violate the bulk, density,parking, landscaping, or open space standards of this Ordinance; and(8) Not constitute a combination use, which is the combination of two principaluses (combination uses will not meet the above standards in terms of beingsubordinate or providing service to the principal use).C. Approval of Accessory Uses and Structures(1) Except for piers, docks, boat houses, boat lifts, a single storage shed (for theupkeep of a lot), ponds or borrow pits, and community agriculture, noaccessory use shall be located on a lot prior to development of an associatedprincipal use.(2) An accessory use or structure may be approved in conjunction with orsubsequent to approval of the principal use or structure.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.46
