Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.5: Planned <strong>Development</strong>D. Planned <strong>Development</strong> Review StandardsThe advisability of establishing a planned development is a matter committed to thelegislative discretion of the Board of Commissioners and is not controlled by any onefactor. In determining whether to adopt or deny a planned development, the Board ofCommissioners shall consider the standards in Section 2.4.3.C, Zoning MapAmendment Standards, and the standards for the proposed type of PD district inSection 3.7, Planned <strong>Development</strong> Base Zoning Districts.E. Designation on the Official Zoning MapDesignation of a PD zoning district on the Official Zoning Map shall note the ordinancenumber approving the PD zoning classification.F. EffectLands rezoned to a PD district shall be subject to the approved PD master plan andthe approved PD terms and conditions. The master plan and terms and conditions arebinding on the land as an amendment to the Official Zoning Map. The applicant mayapply for and obtain subsequent development permits and approvals necessary toimplement the PD master plan in accordance with the appropriate procedures andstandards set forth in this <strong>Ordinance</strong>. Any permits or approvals shall comply with thePD master plan and the PD terms and conditions.G. Expiration(1) If no application for approval of a preliminary plat or site plan for any part ofthe approved PD master plan is submitted within two years after approval ofthe planned development, the Planning Director shall initiate a mapamendment application to rezone the land back to its prior zoningclassification or any other base zoning classification determined to beappropriate. Such time period shall not be extended with transfer ofownership.(2) Upon written request submitted at least 30 days before expiration of the twoyearperiod provided in Section 2.4.5.G.1 above, and upon a showing of goodcause, the Planning Director may grant one extension not to exceed sixmonths for the applicant to submit required development applications.H. Minor Deviation(1) GeneralSubsequent plans and permits for development within an approved planneddevelopment may include minor deviations from the PD master plan or PDterms and conditions, provided such deviations are limited to changesaddressing technical considerations that could not reasonably be anticipatedduring the PD zoning classification process or any other change that has nomaterial effect on the character of the approved planned development or anyof its approved terms or conditions. Changes in the following shall constituteminor deviations and may be approved by the Planning Director:(a)(b)(c)(d)Driveway locations;Structure floor plan revisions;Minor shifts in building size or location; andFacility design modifications for amenities and the like.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.38
