FindingsThe Board of Commissioners finds and determines that development agreements maybe useful to both Currituck County and developers by providing more regulatorycertainty, establishing a schedule for development, and assisting both developers andthe county coordinate the provision of adequate public facilities to serve development,coordinate the phasing of development, and administer and manage efforts to maintainopen space and environmentally sensitive lands.C. AuthorityThe county may enter into a development agreement with a developer, subject to theprocedures and standards of Part 3A of Article 18 of Chapter 153A of the NorthCarolina General Statutes. In entering into a development agreement, the county maynot exercise any authority or make any commitment not authorized by general orlocal act, and may not impose any tax or fee not authorized by otherwise applicablelaw.D. Development Agreement Procedure(1) Pre-Application ConferenceOptional (see Section 2.3.2).(2) Community MeetingOptional (see Section 2.3.3).(3) Application Submittal and AcceptanceApplicable (see Section 2.3.4).PublicNotificationPlanningBoardMeeting /RecommendationBoard ofCommissionersHearing /DecisionNotice ofDecisionAnnualReviewDevelopmentAgreement(4) Staff Review and ActionApplicable (see Section 2.3.5). The Technical Review Committee shall reviewthe application, prepare a staff report, and provide a recommendation inaccordance with Section 2.3.5.B, Staff Report and Recommendation, andSection 2.4.18.E, Development Agreement Review Standards.(5) Public Hearing Scheduling and Public NotificationApplicable (see Section 2.3.6).(6) Public Hearing ProceduresApplicable (see Section 2.3.8).(7) Advisory Body Review and RecommendationApplicable (see Section 2.3.9). The Planning Board, following a public meeting,shall make a recommendation on the application in accordance with Section2.3.9, Advisory Body Review and Recommendation, and Section 2.4.18.E,Development Agreement Review Standards.(8) Decision-Making Body Review and DecisionApplicable (see Section 2.3.10). The Board of Commissioners, following alegislative public hearing (Section 2.3.8.B), shall decide the application inaccordance with Section 2.4.10, Decision-Making Body Review and Decision,and Section 2.4.18.E, Development Agreement Review Standards.
