Chapter 7: Environmental ProtectionSECTION 7.2: TREE PROTECTIONSubsection 7.2.4: Responsibility for Compliance(3) Establishment PeriodReplacement trees shall be maintained through an establishment period of atleast three years. The applicant shall guarantee the survival and health of allreplacement trees during the establishment period and guarantee anyassociated replacement costs (see Section 6.3, Performance Guarantees). Ifthe replacement trees do not survive the establishment period, the applicantshall purchase and install new replacement trees.7.2.4. Responsibility for ComplianceFailure to comply with the standards of this section is a violation of this <strong>Ordinance</strong> subject tothe remedies and penalties in this section and Chapter 9: Enforcement.7.2.5. Tree Protection During ConstructionA. Owner’s ResponsibilityDuring development, the owner or developer shall be responsible for the erection ofany and all barriers necessary to protect any heritage trees or existing vegetation tobe credited towards landscaping requirements from damage during construction.B. Tree Protection Fencing(1) Where RequiredHeritage trees and existing trees being used for credit towards landscapingrequirements retained in a tree protection zone shall be fenced with a sturdyand visible fence before grading or other development activity begins. ThePlanning Director shall consider the existing site conditions and the location ofallowable encroachments in determining the exact location of tree protectionfencing. Areas located inside of tree protection fencing are considered as“tree save areas.”(2) Type of FencingAll fencing required by this section shall be a minimum four feet high and ofdurable construction (i.e., chain link or wooden post with 2x4 wire mesh).Posts shall be located no more than ten feet on-center (see Figure 7.2.5, TreeProtection Fencing). Passive forms of tree protection may be utilized todelineate tree protection zones that are remote from areas of landdisturbance. These must be surrounded by fencing, continuous rope, ordurable taping (minimum four inches wide).CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE7.11
