Chapter 7: Environmental ProtectionSECTION 7.4: FLOOD DAMAGE PREVENTIONSubsection 7.4.6: Standards(g)(h)(i)(j)(k)(l)(m)(n)(o)(p)On-site waste disposal systems shall be located and constructed toavoid impairment to them or contamination from them duringflooding.Nothing in this <strong>Ordinance</strong> shall prevent the repair, reconstruction, orreplacement of a building or structure existing on January 1, 2013 andlocated totally or partially within the floodway, non-encroachmentarea, or stream setback, provided there is no additional encroachmentbelow the regulatory flood protection elevation in the floodway, nonencroachmentarea, or stream setback, and provided that such repair,reconstruction, or replacement meets all of the other requirements ofthis <strong>Ordinance</strong>.All developments shall be consistent with the need to minimize flooddamage.All developments shall have public utilities and facilities such as sewer,gas, electrical, and water systems located and constructed to minimizeflood damage.All developments shall have adequate drainage provided to reduceexposure to flood hazards.All developments shall have received all necessary permits required byFederal or State law, including Section 404 of the Federal WaterPollution Control Act Amendments of 1972, 33 U.S.C. 1334.When a new structure is partially located in the special flood hazardarea, the entire structure shall meet the requirements in this section.When a structure is located in multiple flood zones or in a flood zonewith multiple base flood elevations, the provisions for the morerestrictive flood zone and the highest base flood elevation shall apply.Any alteration, repair, reconstruction, or improvements to astructure, which is in compliance with the standards of this ordinance,shall meet the requirements of “new construction” as contained in thisordinance.New solid waste facilities and sites, hazardous waste managementfacilities, salvage yards, and chemical storage facilities shall not bepermitted, except by variance as specified in Section 2.4.14.F, Variancefrom Flood Protection Standards. A structure or tank for chemical orfuel storage incidental to an allowed use or to the operation of awater treatment plant or wastewater treatment facility may be locatedin a special flood hazard area only if the structure or tank is eitherelevated or floodproofed to at least the regulatory flood protectionelevation and certified in accordance with the standards of thisordinance.(2) Residential <strong>Development</strong>In addition to the general standards applied to all development in (1) above,new construction and substantial improvement of any residential structure(including manufactured homes) shall have the reference level, includingbasement, elevated no lower than the regulatory flood protection elevation.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE7.24
