Use Permit Procedure(1) Pre-Application ConferenceApplicable (see Section 2.3.2).(2) Community MeetingApplicable (see Section 2.3.3).(3) Application Submittal and AcceptanceApplicable (see Section 2.3.4).(4) Staff Review and ActionApplicable (see Section 2.3.5). The Technical Review Committee shall reviewthe application, prepare a staff report, and provide a recommendation inaccordance with Section 2.3.5.B, Staff Report and Recommendation, andSection 2.4.6.D, Use Permit Review Standards.(5) Public Hearing Scheduling and Public NotificationApplicable (see Section 2.3.6).(6) Public Hearing ProceduresApplicable (see section 2.3.7).(7) Advisory Body Review and Recommendation(a)(b)Applicable (see Section 2.3.9). The Planning Board, following a publicmeeting, shall make a recommendation on the application inaccordance with Section 2.3.9, Advisory Body Review andRecommendation, and Section 2.4.6.D, Use Permit Review Standards.During its review of the application, the Planning Board may proposeconditions of approval in accordance with Section 2.3.11, Conditionsof Approval.(8) Decision-Making Body Review and Decision(a)(b)(c)Applicable (see Section 2.3.10). The Board of Commissioners,following a quasi-judicial public hearing (see Section 2.3.8.C), shalldecide the application in accordance with Section 2.3.10, Decision-Making Body Review and Decision, and Section 2.4.6.D, Use PermitReview Standards. The decision shall be the one of the following:(i)(ii)(iii)(iv)Adoption of the use permit;Adoption of the use permit subject to conditions of approval;Denial of the use permit; orRemand of the use permit application back to the PlanningBoard for further consideration.The Board of Commissioners may attach additional conditions ofapproval, including timing limits on residential building lots or unitsavailable for occupancy, to assure adequate public facilities remainsufficient to serve the development.Any conditions of approval shall meet or exceed the minimumrequirements of this <strong>Ordinance</strong>.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.40
