Chapter 5: <strong>Development</strong> StandardsSECTION 5.13: INCENTIVES FOR SUSTAINABLE DEVELOPMENT PRACTICESSubsection 5.13.3: ApplicabilityB. <strong>Development</strong> may include a sufficient number of sustainable development practices totake advantage of more than one type of incentive, but in no instance shall the amountof an incentive be increased or decreased (as appropriate) beyond the maximum listedin this sub-section.5.13.3. ApplicabilityThe incentives included in this section are available to new development in the MXR, businessand mixed-use districts, and planned development districts, except that incentives related toresidential density or building height, shall be limited to uses only in the MXR, CC, and VCdistricts.5.13.4. Conflict with Community Compatibility StandardsIn cases where bonuses in this section conflict with the community compatibility standards inSection 5.11, the community compatibility standards shall control.5.13.5. ProcedureA. <strong>Development</strong> seeking to use incentives shall include a written request with thedevelopment application that demonstrates how compliance with the standards will beachieved.B. Review for compliance with this section, and granting of requests in accordance withthis section shall occur during review of a site plan (Section 2.4.7), planneddevelopment master plan (Section 2.4.5), use permit (Section 2.4.6), or zoningcompliance permit (Section 2.4.9), as appropriate. The decision-making bodyresponsible for review of the development application shall also be responsible for thereview of sustainable development incentive request.C. The incentive shall be based on the number of sustainable development practicesprovided, in accordance with Table 5.13.A, Sustainable <strong>Development</strong> PracticeIncentives, and Section 5.13.G, Menu of Sustainable <strong>Development</strong> Practices.
