Chapter 6: Subdivision and Infrastructure StandardsSECTION 6.4: CONSERVATION SUBDIVISIONSubsection 6.4.1: Purpose and Intent(3) Acceptance Shall be DocumentedThe county shall provide written notice of the county’s final acceptance of theimprovements subject to a performance guarantee.F. Default and Forfeiture of Performance Guarantee(1) Notice of Failure to Install or Complete ImprovementsIf the owner or developer fails to complete installation of the guaranteedimprovements within the term of the performance guarantee (as may beextended), the Planning Director shall give the owner or developer 30 dayswritten notice of the default by certified mail.(2) <strong>County</strong> Completion of ImprovementsAfter the 30-day notice period expires, the county may draw on the guaranteeand use the funds to perform work necessary to complete installation of theguaranteed improvements. After completing such work, the county shallprovide a complete accounting of the expenditures to the owner or developerand, as applicable, refund all unused funds, without interest.6.4. CONSERVATION SUBDIVISION6.4.1. Purpose and IntentThe purpose and intent of this section is to provide landowners in the AG and SFM zoningdistricts a development option that provides additional development flexibility to build onsmaller lots when additional open space set-asides are provided, and the development isdesigned and located in a way that protects the agricultural activities or natural and historicfeatures on the site. This is done in order to:A. Conserve Open LandConserve open land, including those areas containing productive agricultural soils,unique and sensitive natural features such as floodplains, wetlands, river and streamcorridors, area with mature hardwood trees or maritime forests, and watersheds;B. Retain and Protect Natural ResourcesRetain and protect existing environmental, natural, and cultural resources;C. Link Open SpacesCreate a linked network of open lands;D. Promote Rural CharacterPromote existing rural character within the agricultural portions of the county; andE. Provide Reasonable Use of PropertyProvide reasonable economic use of the property.6.4.2. ApplicabilityThis conservation subdivision option shall be used for single-family detached subdivisions of sixor more lots in the Agricultural (AG) zoning district, and may be used for single-familydetached subdivisions in the Single-Family Mainland (SFM) zoning district.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE6.25
