Chapter 4: Use StandardsSECTION 4.3: ACCESSORY USE STANDARDSSubsection 4.3.3: Specific Standards for Certain Accessory Uses(d)Plantings shall not obstruct roadway visibility or impede the flow oftraffic.G. Drive-Through(1) Drive-through facilities shall be located at least 100 feet from any detachedsingle-family dwelling or single-family residential zoning district.(2) Outdoor speakers associated with a drive-through shall be at least 50 feetfrom any lot line.(3) Drive-through facilities shall not be located on the front façade of the buildingthey serve.(4) Drive-through facilities shall be designed so as not to obstruct the movementof pedestrians along sidewalks, through areas intended for public use, orbetween the building entrance and customer parking spaces.(5) Canopies or other features installed over a drive through window shallmaintain common roof lines and materials with the principal structureH. Electronic Gaming OperationElectronic gaming operations are permitted only as an accessory use and shall complywith the following standards:(1) General Requirements(a) Each electronic gaming operation shall be limited to a maximum of 5gaming terminals per location, regardless of size.(b) No electronic gaming operation shall be located within 500 feet of aschool, child care center, religious institution, or other electronicgaming operation. The measurement of distance shall be a straight linefrom the closest point of the buildings at which the uses are located,not the closest point of the unit or space within the buildings at whichthe electronic gaming operation is located.(c) Electronic gaming operations are prohibited in the Outer Banks.(d) On premise signs advertising the electronic gaming operation areprohibited.(2) Operation Requirements(a)(b)(c)(d)(3) AmortizationOperating hours shall be the same as the principal retail salesestablishment.There shall be no alcohol sold, provided, or consumed in the gamingarea.The establishment shall be restricted to patrons and employees atleast 18 years of age.No firearms are allowed inside any gaming area, except by sworn lawenforcement officials or security employees.Any electronic gaming operation that lawfully existed prior to May 6, 2013 willbe granted 6 months from May 6, 2013 in which to bring the electronic gamingoperation into compliance with the standards of this <strong>Ordinance</strong>.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.53
