Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.16: Interpretation(c)(d)Modifications in building setbacks by up to 15 percent in all otherareas in the county;Modifications in major arterial street setbacks by up to 40 percent,provided the structure maintain a minimum distance of at least 20 feetfrom the major arterial street;(2) The administrative adjustment is consistent with the character of developmenton surrounding land, and is compatible with surrounding land uses;(3) The administrative adjustment is either:(a)(b)(c)Required to compensate for some unusual aspect of the site or theproposed development that is not shared by landowners in general;Supports an objective or goal from the purpose and intent statementsof the zoning district where it is located; orSaves healthy existing trees;(4) The administrative adjustment will not pose a danger to the public health orsafety;(5) Any adverse impacts will be mitigated, to the maximum extent practicable; and(6) The site is not subject to a series of multiple, incremental administrativeadjustments that result in a reduction in development standards by themaximum allowed.F. Effect of <strong>Development</strong> ApprovalApplicable (see Section 2.13.13)G. Amendment of <strong>Development</strong> ApprovalApplicable (see Section 2.3.14).H. Expiration of <strong>Development</strong> ApprovalUnless otherwise specified in the approval, an application for a building permit shall beapproved within one year of the date of the approval of the administrative adjustment,or the administrative adjustment shall become null and void, and automatically expire.Permitted timeframes do not change with successive owners.2.4.16. InterpretationA. PurposeThe purpose of this section is to provide a uniform mechanism for rendering formalwritten interpretations of the text of this <strong>Ordinance</strong> and the boundaries orclassifications on the Official Zoning Map.B. ApplicabilityThe Planning Director is responsible for making interpretations of all provisions of this<strong>Ordinance</strong>, including, but not limited to:(1) Interpretations of the text;(2) Interpretations of the zoning district boundaries;CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.67
