Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.2: Text AmendmentPre-ApplicationConferenceSubmitApplicationDetermination ofCompletenessStaff Review andReportScheduleMeeting andHearingPublicNotificationPlanningBoardMeeting /RecommendationBoard ofCommissionersHearing /DecisionNotice ofDecisionTextAmendmentperson who may submit applications in accordance with Section 2.3.4.A,Authority to File Applications, or any other interested party.(4) Staff Review and ActionApplicable (see Section 2.3.5). The Planning Director shall review theapplication, prepare a staff report, and provide a recommendation inaccordance with Section 2.3.5.B, Staff Report and Recommendation, andSection 2.4.2.C, Text Amendment Review Standards.(5) Public Hearing Scheduling and Public NotificationApplicable (see Section 2.3.6).(6) Public Hearing ProceduresApplicable (see Section 2.3.8).(7) Advisory Body Review and RecommendationApplicable (see Section 2.3.9). The Planning Board, following a public meeting,shall make a recommendation on an application in accordance with Section2.3.9, Advisory Body Review and Recommendation, and Section 2.4.2.C, TextAmendment Review Standards.(8) Decision-Making Body Review and Decision(a)(b)Applicable (see Section 2.3.10). The Board of Commissioners,following a legislative public hearing (see Section 2.3.8.B), shall decidethe application in accordance with Section 2.3.10, Decision-MakingBody Review and Decision, and Section 2.4.2.C, Text AmendmentReview Standards. The decision shall be one of the following:(i)(ii)(iii)(iv)Adoption of the text amendment as proposed;Adoption of a revised text amendment;Denial of the text amendment; orRemand of the text amendment application back to thePlanning Board for further consideration.In making its decision, the Board of Commissioners shall adopt awritten statement of consistency and reasonableness that:(i)(ii)Describes whether the decision is consistent with all countyadoptedplans that are applicable; andExplains why the decision is reasonable and in the publicinterest.C. Text Amendment Review StandardsThe advisability of amending the text of this Ordinance is a matter committed to thelegislative discretion of the Board of Commissioners and is not controlled by any onefactor. In determining whether to adopt or deny the proposed text amendment, theBoard of Commissioners may weigh the relevance of and consider whether and theextent to which the proposed text amendment:(1) Is consistent with the goals, objectives, and policies of the Land Use Plan andother applicable county-adopted plans;CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.30
