Chapter 10: Definitions and MeasurementSECTION 10.5: DEFINITIONSAffected Partyi. persons who appear nude or semi-nude; orii. live performances which are characterized by the exposure of specifiedanatomical areas or by specified sexual activities; oriii. films, motion pictures, videocassettes, digital reproductions, slides, or otherphotographic reproductions which depict or describe specified sexual activitiesor specified anatomical areas.d. Adult Motion Picture Theater: An establishment where, for any form ofconsideration, films, motion pictures, video cassettes, digital reproductions, slides, orsimilar photographic reproductions are regularly shown as one of its principal businesspurposes that depict or describe specified sexual activities or specified anatomicalareas.e. Adult Theater: A theater, concert hall, auditorium or similar establishmentcharacterized by (activities featuring) the exposure of specified anatomical areas or byspecified sexual activities.f. Escort Agencies: A person or business that furnishes, offers to furnish, or advertisesto furnish escorts as one of its principal business purposes, for a fee, tip, or otherconsideration.g. Massage Business: Any establishment or business wherein massage is practiced,including establishments commonly known as massage studios or massage parlors.Specifically excluded from this definition are massages under the direct supervision of(i) a licensed physician (ii) a masseuse licensed in the State of North Carolina, or (iii)where massage is an accessory to the principle use (except as an accessory to an adultestablishment or sexually oriented business) such as at health clubs and beauty salons.h. Specified Anatomical Areas: Specified anatomical areas shall be defined as less thancompletely and opaquely covered human genitals, pubic regions, buttocks and femalebreasts below a point immediately above the top of the areola; or human male genitalsin a discernibly turgid state, even if completely and opaquely covered.i. Specified Sexual Activities: Specified sexual activities shall include, but are not limitedto, the following:i. human genitals in a state of sexual stimulation, arousal, or tumescence; orii. sex acts, normal or perverted, actual or simulated, including humanmasturbation, sexual intercourse, sodomy, or oral copulation; oriii. fondling or other erotic touching of human genitals, pubic regions, buttocks,anus, or female breasts.AFFECTED PARTYOwners of land adjoining the land subject to an application and any other person who couldsuffer an adverse effect to a property interest from a proposed development.AGGRIEVED PARTYA person, with a legally recognized interest (i.e., fee simple ownership) and standing to appeal,that is injuriously affected by a decision from any decision-making body of the county, includingany officer or agent of the county.AGRIBUSINESSA commercial enterprise in which agriculture products produced on a site are marketed andsold directly to consumers without an intermediate wholesaler or distributor, other than afarm co-op organization.
