Chapter 10: Definitions and MeasurementSECTION 10.5: DEFINITIONSNonconforming StructureNONCONFORMING STRUCTUREA structure or building, the size, dimensions, or location of which was lawful prior to theadoption, revision, or amendment to this <strong>Ordinance</strong> but that fails by reason of such adoption,revision, or amendment to conform to the present requirements of the zoning district.NONCONFORMING USEAny actual and active use lawfully being made of any land, building, sign or structure nototherwise abandoned, which exists on the effective date of this <strong>Ordinance</strong> or on the effectivedate of any amendment thereto, and renders such existing use illegal within a district, or whichdoes not comply in any fashion with any of the regulations of this <strong>Ordinance</strong> or anyamendments thereto. If the property or structure is vacant or unused on the effective date ofthis <strong>Ordinance</strong> or any amendment thereto, it shall be conclusively presumed that the propertyor structure is subject to the provisions of this <strong>Ordinance</strong> or any amendments thereto. A useor activity that was lawful prior to the adoption, revision or amendment of the zoningordinance but that fails by reason of such adoption, revision, or amendment to conform to thepresent requirements of the zoning district.NONCONFORMITYA nonconforming use, structure, lot of record, sign, or site feature.NORTH CAROLINA COMMERCIAL BUILDING CODEA set of standards and regulations established by the North Carolina Building Council thatcontrol building design, construction, and materials used in commercial or nonresidentialconstruction.NORTH CAROLINA GENERAL STATUTESThe laws created by the State of North Carolina legislature and to which <strong>Currituck</strong> <strong>County</strong> isrequired to uphold.NOTICE OF APPEALThe document and justification for an appeal of a decision or interpretation made by a countystaff member.NOTICE OF VIOLATIONA notice indicating an infraction of this <strong>Ordinance</strong>; not associated with a fine.NURSERY, PRODUCTIONThe growing, storage, storage, and sale of garden plants, shrubs, trees, vines, groundcovers,and other related landscaping materials for resale, typically occurring as wholesale or retailsales directly to landscaping professionals. Such uses may include limited incidental retail salesto members of the general public. Such uses may include greenhouses; outdoor storage ofgoods, materials, and equipment; irrigation systems; and caretaker’s dwelling.NURSING HOMEAny facility or any identifiable component of any facility in which the primary function is theprovision, on a continuing basis, of nursing services and health-related services for thetreatment and inpatient care of two or more non-related individuals, including facilities knownby varying nomenclature or designation such as rest homes, convalescent homes, skilled carefacilities, intermediate care facilities, extended care facilities and infirmaries.
