Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.5: Planned <strong>Development</strong>Pre-ApplicationConferenceCommunityMeeting(c)(d)circulation, open space, public facilities, and phasing (see Section3.7.2.A, Planned <strong>Development</strong> Master Plan).The application shall also include a terms and conditions documentspecifying terms and conditions defining development parameters,providing for environmental mitigation, and outlining how publicfacilities will be provided to serve the planned development.To ensure unified control, the application shall also include a copy ofthe title to all land that is part of the proposed PD zoning districtclassification.SubmitApplication andMaster PlanDetermination ofCompletenessTRC Review andReportScheduleMeeting andHearingPublicNotificationPlanningBoardMeeting /RecommendationBoard ofCommissionersHearing /DecisionNotice ofDecisionUpdate ZoningMapPlanned<strong>Development</strong>(4) Staff Review and ActionApplicable (see Section 2.3.5). The Technical Review Committee shall reviewthe application, prepare a staff report, and provide a recommendation inaccordance with Section 2.3.5.B, Staff Report and Recommendation, andSection 2.4.5.D, Planned <strong>Development</strong> Review Standards.(5) Public Hearing Scheduling and Public NotificationApplicable (see Section 2.3.6).(6) Public Hearing ProceduresApplicable (see Section 2.3.8).(7) Advisory Body Review and RecommendationApplicable (see Section 2.3.9). The Planning Board, following a public meeting,shall make a recommendation on the application in accordance with Section2.3.9, Advisory Body Review and Recommendation, and Section 2.4.5.D,Planned <strong>Development</strong> Review Standards.(8) Decision-Making Body Review and Decision(a)(b)Applicable (see Section 2.3.10). The Board of Commissioners,following a legislative public hearing (Section 2.3.8.B), shall decide theapplication in accordance with Section 2.3.10, Decision-Making BodyReview and Decision, and Section 2.4.5.D, Planned <strong>Development</strong>Review Standards. The decision shall be one of the following:(i)(ii)(iii)(iv)Approval of the planned development subject to the PDmaster plan and PD terms and conditions in the application;Approval of the planned development subject to additional orrevised conditions related to the PD master plan or PD termsand conditions;Denial of the planned development; orRemand of the planned development application back to thePlanning Board for further consideration.As part of the decision, the Board of Commissioners shall adopt awritten statement of consistency and reasonableness that:(i)(ii)Describes whether the decision is consistent with all countyadoptedplans that are applicable; andExplains why the decision is reasonable and in the publicinterest.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.37
