Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.8: SubdivisionH. Amendment of <strong>Development</strong> ApprovalApplicable (see Section 2.3.14).I. Expiration of <strong>Development</strong> ApprovalSite plan approval shall automatically expire at the end of two years following the dateof approval if a building permit for at least one building in the site plan is not approved.A change in the ownership in land does not affect this time period.2.4.8. SubdivisionA. PurposeThe purpose of this section is to provide a uniform means for the review and approvalof divisions of land and to ensure, in conjunction with Chapter 6: Subdivision andInfrastructure Standards, that subdivisions promote the health, safety, convenience,order, prosperity, and welfare of the present and future residents of the county by:(1) Providing for the orderly growth and development of the county;(2) Coordinating streets within proposed subdivisions with the existing streetsystem, transportation plans, and other public facilities;(3) Providing rights-of-way for streets and utility easements;(4) Avoiding congestion and overcrowding, and encouraging the properarrangement of streets in relation to existing or planned streets;(5) Ensuring there is adequate open space and recreation facilities to servedevelopment; and(6) Ensuring there is proper recordation of land ownership or property ownerassociation records, where applicable.B. Applicability(1) GeneralUnless exempted in accordance with subsection B.2 below, before the divisionof land (whether improved or unimproved) into two or more lots is recordedor otherwise made effective, the landowner shall comply with therequirements of this section.(2) Exemptions(a)(b)The division of a tract or parcel transferred to the county, State, orFederal government is exempt from subdivision review and thestandards in Chapter 6; Subdivision and Infrastructure Standards,provided the transferred tract or parcel is for the conservation ofnatural resources, utilities, or other public purposes. The subsequenttransfer of government property to a non-governmental entity, furtherdivision of the property for non-public uses, and any resultant lot shallbe subject to the requirements of this section.No-review subdivisions are exempt from subdivision review, but shallbe required to comply with the relevant standards in Chapter 6:Subdivision and Infrastructure Standards, all other applicable standardsin this <strong>Ordinance</strong>, and the <strong>County</strong> Code of <strong>Ordinance</strong>s.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.44
