Chapter 2: AdministrationSECTION 2.3: STANDARD PROCEDURESSubsection 2.3.4: Application Submittal and Acceptance(b) If the applicant fails to resubmit a complete application within 45calendar days after being first notified of submittal deficiencies, theapplication shall be considered withdrawn.(c) Incomplete appeal applications shall be resubmitted and determinedcomplete within the time specified in Section 2.4.17.B. Failure to doso will result in the interpretation, decision, or notice of violationbeing considered final.(d) The Planning Director shall not process an application for furtherreview until it is determined to be complete.(3) Application CompleteOn determining that the application is complete, the Planning Director shallaccept the application for review in accordance with the procedures andstandards of this <strong>Ordinance</strong>.G. Application Revision(1) An applicant may revise an application after receiving initial staff reviewcomments on the application, or on requesting and receiving permission fromthe TRC or an advisory or decision-making body after that body has reviewedbut not yet taken action on the application.(2) Revisions shall be limited to changes that directly respond to specific requestsor suggestions made by the staff, TRC, or the advisory or decision-makingbody, and shall not constitute significant substantive revisions to thedevelopment proposed in the application. For the purposes of this subsection,significant substantive revisions include, but are not limited to:(a)(b)(c)(d)(e)(f)(g)(h)(i)(j)(k)Increases in density;Increases in building height by 10 percent or more;Increases in lot coverage by 10 percent or more;Increases in floor area by 20 percent or more;Increases in the number of lots;Relocation of lot lines by two feet or more;Relocation of streets or driveways by two feet or more;Decreases in tree protection zones or open space set-asides;Decreases in the amount of landscaping provided by 10 percent ormore;Decreases in setbacks from sensitive environmental features of two ormore feet; orChanges to a more intense use type.(3) Any other revisions (including significant substantive revisions) to theapplication may be submitted at any time during the review procedure, but therevised application shall be submitted to the Planning Director and reviewedas if it were a new application. The revised application submittal shall besubject to additional application fees to defray the additional costs ofprocessing the revised application.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.16
