Chapter 4: Use StandardsSECTION 4.4: TEMPORARY USE STANDARDSSubsection 4.4.6: Specific Regulations for Certain Temporary Uses and Structures(b)(c)(d)(e)(f)The temporary structure shall be factory-fabricated and transportable.Allowable structures include campers, travel trailers, recreationalvehicles, FEMA trailers, or similar structures, but shall not consist of aclass “B” or class “C” manufactured home;The temporary residence may only be occupied by persons intendingto reside in the permanent dwelling as a primary residence.In addition to any other off-street parking required on the site inaccordance with Section 5.1, Off-Street Parking and Loading, adequateoff-street parking shall be provided for the temporary use;All permits required by applicable building, electrical, plumbing, andmechanical codes shall be obtained prior to installation of thetemporary structure; andThe temporary structure shall be compatible with the existingbuildings on the site in terms of exterior color, design, and placement,to the maximum extent practicable.C. Outdoor Seasonal Sales(1) Applicability(a)(b)The outdoor display and/or sale of goods consistent with theprovisions of Section 4.3.3.O, Outdoor Display/Sales, is considered anaccessory use and does not require a temporary use permit.All other sales/displays of goods (other than agricultural products)require a temporary use permit in accordance with Section 2.4.11,Temporary Use Permit, and this subsection.(2) StandardsA temporary use for the temporary display and/or sale of products shallcomply with the following standards:(a)(b)(c)(d)(e)The land contains an area not actively used that will support theproposed temporary sale of products without encroaching into orcreating a negative impact on existing vegetated areas, open space,landscaping, traffic movements, or parking-space availability.The display or sale of goods, products, and/or services shall not occurin the public right-of-way or within 200 feet of an existing residentialuse.The display or sale of products, goods and/or services shall be limitedin scope to similar or complementary products, goods, and/or servicesto those offered by the existing principal use located on the same site.The temporary sale of non-agricultural products, goods, and/orservices that differ from the normal range of those offered by anexisting principal use shall be prohibited.No more than two tents or other temporary structures shall beerected.Tents and other temporary structures shall be located so as not tointerfere with the normal operations of any permanent use located onthe property.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.67
