Chapter 5: <strong>Development</strong> StandardsSECTION 5.4: EXTERIOR LIGHTINGSubsection 5.3.8: Maintenance(2) Underground electric fences designed for control of domestic animals areallowed.B. Debris, Junk, Rolled Plastic, Sheet Metal, Plywood, or Other WasteMaterialsFences or walls made of debris, junk, rolled plastic, sheet metal, plywood, or wastematerials are prohibited in all zoning districts unless such materials have been recycledand reprocessed, for marketing to the general public, as building materials designed toresemble new building materials (e.g., picket fencing made from recycled plastic andfiber).5.3.8. MaintenanceAll fences and walls and associated landscaping shall be maintained in good repair and in a safeand attractive condition, including but not limited to, the replacement of missing, decayed, orbroken structural and decorative elements. All fences and walls shall receive regular structuralmaintenance to prevent and address sagging and weathering of surfaces visible from the publicright-of-way. Any deteriorated, damaged, or decayed fence materials shall be repaired and anyfence or wall post or section that leans more than ten degrees from vertical shall be repairedwithin 30 days to correct that condition.5.4. EXTERIOR LIGHTING5.4.1. Purpose and IntentThe purpose of this section is to regulate light spillage and glare to ensure the safety ofmotorists and pedestrians, and to ensure lighting does not adversely affect land uses onadjacent lands. More specifically, this section is intended to:A. Regulate lighting to assure that excessive light spillage and glare are not directed atadjacent lands, neighboring areas, and motorists;B. Ensure that all site lighting is designed and installed to maintain adequate lighting levelson site;C. Avoid negative impacts from exterior lighting on coastal wildlife habitat; andD. Provide security for persons and land.5.4.2. ApplicabilityA. GeneralThe provisions of this section shall apply to all development in the county unlessexempted in accordance with Section 5.4.2.D, Exemptions.B. Time of ReviewReview for compliance with the standards of this section shall occur as part of thereview of an application for a site plan (Section 2.4.7), planned development masterplan (Section 2.4.5), or zoning compliance permit (Section 2.4.9), as appropriate.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE5.39
