Chapter 2: AdministrationSECTION 2.4: SPECIFIC REVIEW PROCEDURESSubsection 2.4.6: Use Permit(2) Material Changes are AmendmentsChanges that materially affect the basic concept of the PD master plan or basicparameters set by the PD terms and conditions are not considered minordeviations, and shall only be changed as amendments to the PD master plan orPD terms and conditions.I. Amendments2.4.6. Use Permit(1) GeneralIf an applicant determines it is necessary to alter the concept or intent of thePD master plan or the PD terms and conditions, the PD master plan or PDterms and conditions shall be amended, extended, or modified only inaccordance with the procedures and standards for its original approval.(2) Amendments DefinedThe following items are considered an alteration of the concept or intent ofthe PD master plan or PD terms and conditions and are treated as anamendment:(a)(b)(c)(d)(e)(f)Changes in use designations;Density/intensity increases;Decreases in open space;Substantial changes in the location of streets (particularly if streets areto be deleted or access points to the development moved so trafficflows both inside and outside the development are affected);Change in the location of any public easement; orChange in the proportion of housing types by more than 15 percent.A. PurposeA use requiring a use permit in a particular zoning district is a use that may beappropriate in the district, but because of its nature, extent, and external effects,requires special consideration of its location, design, and methods of operation beforeit can be deemed appropriate in the district and compatible with its surroundings. Thepurpose of this section is to establish a mechanism to review these kinds of uses toensure they are appropriate for a particular zoning district.B. ApplicabilityThe following forms of development shall obtain use permit approval in accordancewith the standards in this section:(1) Uses identifies as requiring use permits in Table 4.1.1, Summary Use Table, orTable 4.3.2.E, Table of Common Accessory Uses;(2) Type II preliminary plats;(3) Type I preliminary plats when one or more public facilities are at 85 percentor more of maximum capacity; and(4) Commercial structures exceeding 5,000 square feet in area proposed outsidea Full Service area.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE2.39
