Chapter 4: Use StandardsSECTION 4.3: ACCESSORY USE STANDARDSSubsection 4.3.3: Specific Standards for Certain Accessory UsesI. ExcavationMinor excavations for the purpose of establishing a pond or acquiring fill may bepermitted as an accessory use, provided:(1) One acre or less is disturbed (excluding haul roads);(2) Excavation is setback at least 100 feet from all lot lines;(3) Slopes are maintained at no greater than 3:1 above the water, 2:1 below thewater, and an average depth of four feet is maintained; and(4) A performance guarantee of at least $1,000 is posted with the Planning andCommunity <strong>Development</strong> Department to ensure adequate reclamationfollowing excavation.J. Gasoline SalesGasoline sales may be permitted as an accessory use in accordance with the followingstandards:(1) Location(a) Gasoline pumps, canopies, and associated service areas are prohibitedin any established front yard in the CC and VC districts.(b) If the gasoline sales use is located on a corner lot, the lot shall have anarea of at least 30,000 square feet and a frontage of at least 200 feeton each street side. In all other cases, the lot shall have an area of atleast 15,000 square feet and a lot width of at least 150 feet.(2) CirculationThe gasoline sales use shall have no more than two vehicular access points.Access points shall be located at least 150 feet from each other and from anyintersecting street right-of-ways, and at least 15 feet from any other lot line.K. Home OccupationsA home occupation shall be permitted as accessory to any principal dwelling unit,provided that the accessory use will not change the character of the residentialneighborhood in terms of appearance, noise, odors, traffic, or other impacts. Homeoccupations shall be subject to the following standards:(1) The business or service is located within the dwelling or an associatedaccessory building, and does not exceed 25 percent of the heated floor area ofthe principal structure or 1,000 square feet, whichever is less.(2) The principal person or persons providing the business or service resides inthe dwelling on the premises.(3) The home occupation employs no more than one person on the premiseswho do not reside on the premises.(4) The home occupation causes no change in the external appearance of theexisting dwelling and structures on the property.(5) Retail sales of products produced on site shall be limited to lots with streetfrontage on a major arterial street.(6) All vehicles used in connection with the home occupation are of a size, andlocated on the premises in such a manner, so as to not disrupt the quietCURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.54
