Chapter 10: Definitions and MeasurementSECTION 10.4: USE CLASSIFICATIONS, USE CATEGORIES, AND USE TYPESSubsection 10.4.1: GeneralService Use Category because all of the development’s principal uses are in that usecategory. When the principal uses of a development fall within different usecategories, each principal use is classified in the applicable use category and each use issubject to applicable regulations for that use category. <strong>Development</strong>s with multipleprincipal uses, such as shopping centers, shall incorporate only those use types allowedin the applicable zoning district.D. Interpretation of Unlisted Uses(1) Procedure for Interpreting Unlisted Uses as PermittedThe Planning Director may interpret a particular land use not expressly listedin the use table as allowed in a particular zoning district, in accordance withthe procedure in Section 2.4.16, Interpretation, and based on the standards inSection 10.4.1.D.2, Standards for Interpreting Unlisted Uses as Permitted.(2) Standards for Interpreting Unlisted Uses as PermittedThe Planning Director shall interpret an unlisted land use as permitted in aparticular zoning district only after determining that the nature, function, andduration of the use and the impact of allowing it in the zoning district are sosimilar to those of a use type or use category allowable in the zoning districtthat the unlisted land use should be deemed allowable in the same manner asthe similar use type or use category. In making such determination, thePlanning Director shall consider the purpose and intent statements in this<strong>Ordinance</strong> concerning the zoning district, the character of use types allowablein the district, and all relevant characteristics of the unlisted use, including butnot limited to the following:(a)(b)The volume and type of sales, retail, wholesale, etc.;The size and type of items sold and nature of inventory on thepremises;(c) Any processing done on the premises, including assembly,manufacturing, warehousing, shipping, distribution;(d) Any dangerous, hazardous, toxic, or explosive materials used in theprocessing;(e) The nature and location of storage and outdoor display ofmerchandise, whether enclosed, open, inside or outside the principalbuilding; predominant types of items stored (such as business vehicles,work-in-process, inventory, and merchandise, construction materials,scrap and junk, and raw materials including liquids and powders);(f) The type, size, and nature of buildings and structures;(g) The number and density of employees and customers per unit area ofsite in relation to business hours and employment shifts;(h) Transportation requirements, including the modal split for people andfreight, by volume type and characteristic of traffic generation to andfrom the site;(i) Trip purposes and whether trip purposes can be shared by other usetypes on the site;(j) Parking requirements, turnover and generation, ratio of the number ofspaces required per unit area or activity;CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE10.17
