Chapter 10: Definitions and MeasurementSECTION 10.5: DEFINITIONSMuseumMUSEUMA building serving as a repository for a collection of natural, scientific, historical, or literarycuriosities or works of art, and arranged, intended, and designed to be used by members ofthe public for viewing, with or without an admission charge, and which may include as anaccessory use the limited retail sale of goods, services, or products such as prepared food tothe public.NEIGHBORHOOD RECREATION CENTERA facility providing recreation facilities and/or meeting rooms, that is typically oriented toaddressing the recreational needs of the residents of a neighborhood or community area.NEW CONSTRUCTIONFor the purposes of Section 7.4, Flood Damage Prevention, structures for which the “start ofconstruction” commenced on or after the effective date of the initial floodplain managementregulations and includes any subsequent improvements to such structures.NIGHTCLUBAny establishment, whether public or a private club, serving a predominantly adult clientele,and whose primary business is the sale of alcoholic beverages, including beer and wine, forconsumption on the premises in conjunction with dancing or live performances, and which setsa minimum age requirement for entrance. An establishment is not a nightclub if theestablishment: (1) has a Class A restaurant license from the State of North Carolina; (2)maintains a full service restaurant on its premises at all times when it is open to the public forbusiness; and (3) provides facilities for seating not less than 40 persons simultaneously at tablesfor the service of meals. The establishment is also not a nightclub if the establishment allowsentrance at all times to any person regardless of age.NON-ENCROACHMENT AREAThe channel of a river or other watercourse and the adjacent land areas that must be reservedin order to discharge the base flood without cumulatively increasing the water surfaceelevation more than one foot as designated in the Flood Insurance Study report.NON-PARTICIPATING LANDOWNERThe owner of a parcel of land not included in the use permit application for a Wind EnergyFacility, Large.NONCONFORMING LOTA lot, the area, dimensions, or location of which was lawful prior to the adoption, revision, oramendment of this <strong>Ordinance</strong> but that fails by reason of such adoption, revision, oramendment to conform to the present requirements of the zoning district.NONCONFORMING SIGNAny sign lawfully existing on the effective date of this <strong>Ordinance</strong>, or amendment thereto, thatrenders such sign nonconforming because it does not conform to all the standards andregulations of the adopted or amended ordinance.NONCONFORMING SITE FEATUREAny site feature or attribute, including but not limited to off-street parking, landscaping,screening of mechanical equipment, or walls and fences that was lawful at the time ofdevelopment that does not conform to all the standards and regulations of this <strong>Ordinance</strong>.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE10.66
