Chapter 4: Use StandardsSECTION 4.2: USE-SPECIFIC STANDARDSSubsection 4.2.3: Institutional UsesD. Institutions(1) Auditoriums, Conference, and Convention CentersAuditoriums, conference, and convention centers shall comply with thefollowing standards:(a)(b)(c)(d)(e)The parcel or site shall have an area of at least five acres.The building shall be located at least 500 feet from any single-familyresidential zoning district.Dining and banquet facilities may be provided for employees, trainees,and conferees, provided the gross floor area devoted to such facilitiesdoes not exceed 50 percent of the total floor area of the principalbuilding.On-site recreational facilities may be provided for use by employees,trainees, or conferees.No products shall be sold on-site except those that are clearlyincidental and integral to training programs and seminars conducted inthe center (e.g., food items, shirts, glasses and mugs, pens and pencils,and similar items bearing the logo of conference or seminar sponsorsor participants).(2) Halfway HouseHalfway houses shall be separated from any family care home or other halfwayhouse by a minimum of one-half mile.(3) Religious InstitutionsReligious institutions shall comply with the following standards:(a)(b)E. Parks and Open AreasReligious institutions in the SFM, SFO, and SFI districts that include aschool or sanctuary with a capacity of 800 persons or more shallobtain a use permit in accordance with Section 2.4.6, Use Permit.The Planning Director may grant modifications of the above standardson finding the modification is necessary to eliminate a substantialburden on religious exercise, as guaranteed by the federal ReligiousLand Use and Institutionalized Persons Act (RLUIPA) of 2000 (42U.S.C. Sec. 2000), as amended. In doing so, the Planning Director mayimpose conditions consistent with RLUIPA that will substantiallysecure the objectives of the modified standard and substantiallymitigate any potential adverse impact on the environment or adjacentproperties.(1) Cemeteries (as a Principal Use)Except as otherwise required in this UDO, new cemeteries and the expansionof existing cemeteries (as a principal use) shall comply with the followingstandards:(a)New cemeteries shall be located on a site or parcel with an area of atleast 2.5 acres. (This standard shall not apply to existing cemeteriesor the expansion of existing cemeteries.)CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.16
