General Setback Requirements(1) Setback Exemptions(a)(b)(c)Fill and land disturbance setbacks shall not apply to fill necessary forinstallation of driveways, subject to approval by the County Engineer.Lots served by a shared driveway are exempted from the sidesetbacks in the proximity of the driveway. In no instance shall thisprovision exempt structures from compliance with applicable FireCode requirements.Handicap ramps, fences, walls, water-dependent features, landscapingfeatures (arbors, trellises, ornamental pools, etc.), public utility lines,pump or well covers, residential HVAC equipment, flagpoles,mailboxes, or other non-habitable structures of 25 square feet in sizeor less may encroach into a required setback, but shall not impede theflow of stormwater.(2) Setbacks Following Government Acquisition of LandWhere land acquisition for a public purpose reduces the distance between anexisting legally-established structure and an adjacent lot line to an amount lessthan the minimum required, the resulting distance shall be deemed theminimum setback for the lot.(3) Sight TrianglesRegardless of the setbacks applied in a district, no structures shall bepermitted within a required sight triangle.C. Allowable Setback Encroachments(1) Building and Site Features(a)(b)Eaves, gutters, canopies, chimneys, bay windows, and similar buildingfeatures that do not impede the flow of stormwater may encroachinto a required setback up to three feet.Uncovered porches, decks, patios, steps, sidewalks, and similar atgradesite features that do not impede the flow of stormwater mayencroach into a required setback by up to:(i)(ii)Three feet for impervious site features; orFive feet for pervious site features.(2) Public Facilities(a)(b)D. Sight TrianglesCURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCEPublic walkways, boardwalks, sidewalks, and gazebos may be locatedwithin a required setback, but shall not be located within a requiredsight triangle.Guard gates may be placed within a right-of-way with permission ofthe owner of the right-of-way, provided it does not constitute ahazard to the public.(1) General Requirements(a)Minimum sight triangles for stopping conditions when connecting newlocal, collector, or major arterial streets to existing streets is 70 feet10.11
