Chapter 4: Use StandardsSECTION 4.2: USE-SPECIFIC STANDARDSSubsection 4.2.1: Agricultural Uses(2) Minimum SetbacksAll barns, pens, and enclosures shall be located at least 100 linear feet from lotlines and drinking water sources (except those intended for livestock).(3) Fencing or Pens RequiredAnimals (excluding waterfowl) shall be maintained within pens, fenced areas,or other suitable enclosures.(4) Maintenance Required(a)(b)Pens, stalls, and grazing areas shall be maintained in a sanitary mannerfree from noxious odors.Manure stockpiles shall not exceed six feet in height and shall not bepermitted during the period from May 1 until August 31.(5) Temporary Keeping of LivestockTemporary keeping of livestock shall be exempted from these standards, butshall comply with the standards in Section 4.4.6.F, Temporary Keeping ofLivestock.B. Agricultural Support and Services (Directly Related)(1) GeneralAll directly-related agricultural support services shall comply with thefollowing standards:(a)(b)(c)Be allowed only in direct association with an on-going agriculture,horticulture, animal husbandry, or silvicultural use;Be on a lot of at least one acre in size; andBe operated or maintained by the owner or occupant of the land uponwhich the primary agricultural activity is being conducted.(2) Agri-education and Agri-entertainmentAgri-education and agri-entertainment uses shall comply with the followingstandards:(a)(b)(c)(d)(e)Minimum SizeBe at least two acres in area;Obtain Building PermitsObtain building permits and comply with the State Building Code forall structures intended for occupancy by members of the public;Special Event PermitObtain a special event permit for all activities drawing more than 100people to the site per day;Provide Adequate FacilitiesProvide public restrooms, adequate parking, and pedestrian circulationfeatures; andComply with Minimum RequirementsEnsure permanent buildings within 500 feet of a public right-of-waycomply with the landscaping standards in this <strong>Ordinance</strong>.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE4.9
