Chapter 2: AdministrationSECTION 2.3: STANDARD PROCEDURESSubsection 2.3.9: Advisory Body Review and Recommendation(2) Form of DecisionsThe form of all decisions shall include at least the following elements:(a)(b)(c)2.3.9. Advisory Body Review and RecommendationA summary of the information presented before the body.A statement of findings or other factors considered, whichever isappropriate, and a statement of the basis upon which such facts wereapplied with respect to the relevant review standards, if required bystate law.A statement of a recommendation or decision of approval, approvalwith conditions or disapproval (whichever is appropriate).If an application is subject to a recommendation by an advisory body (Planning Board), thereview body shall review and act on the application in accordance with the followingprocedures.A. GeneralThe advisory body shall hold any required public meeting in accordance with Section2.3.8, Public Hearing Procedures, and consider the application, relevant supportmaterials, staff report, and any public comments. It shall then recommend one of thedecisions authorized for the particular type of application, based on the reviewstandards applicable to the application type, as set forth in Section 2.4, Specific ReviewProcedures.B. Clearly State Factors for DecisionThe advisory body’s recommendation shall clearly state the factors considered inmaking the recommendation and the basis or rationale for the recommended decision.C. TimingUnless deferred or subject to a continuance, the advisory body shall provide arecommendation on an application it reviews within two months from the date of itsinitial meeting to consider the application.2.3.10. Decision-Making Body Review and DecisionIf an application is subject to a final decision by the Board of Commissioners or Board ofAdjustment, such decision-making body shall review and decide the application in accordancewith the following procedures.A. GeneralThe decision-making body shall hold any required public hearing(s) in accordance withSection 2.3.8., Public Hearing Procedures, and consider the application, relevantsupport materials, staff report, any advisory body recommendations, and any publiccomments.
