Chapter 10: Definitions and MeasurementSECTION 10.4: USE CLASSIFICATIONS, USE CATEGORIES, AND USE TYPESSubsection 10.4.2: Agricultural Use Classification(k)(l)(m)The amount and nature of any nuisances generated on the premises,including but not limited to noise, smoke, odor, glare, vibration,radiation, and fumes;Any special public utility requirements for serving the proposed usetype, including but not limited to water supply, wastewater output,pre-treatment of wastes and emissions required or recommended, andany significant power structures and communications towers orfacilities; andThe impact on adjacent lands created by the proposed use type, whichshould not be greater than that of other use types allowed in thezoning district.(3) Unlisted Use Not PermittedIf, after applying the criteria in Section 10.4.1.D.2 above, the Planning Directordetermines that a proposed unlisted use is not similar to a listed use, theproposed use shall be prohibited.(4) Effect of Approval of Unlisted Use(a)(b)(c)10.4.2. Agricultural Use ClassificationA. Agriculture/HorticultureAfter interpreting an unlisted use type as permitted in a particularzoning district, the Planning Director shall determine whether theunlisted use is likely to be common or to recur frequently, or whetherits omission from the use table is likely to lead to uncertainty andconfusion. On determining that the unlisted use is likely to becommon or would lead to confusion if unlisted, the Planning Directorshall initiate an application for a text amendment to list the use type inthe use table. Until final action is taken on the text amendmentapplication, the Planning Director interpretation shall be binding.If after interpreting an unlisted land use as permitted in a particularzoning district, the Planning Director determines that the unlisted useis of an unusual or transitory nature, and unlikely to recur frequently,the interpretation shall be binding in accordance with Section 2.4.16.E,Effect of Interpretation, without further action or amendment of this<strong>Ordinance</strong>.The Planning Director’s interpretation may be appealed in accordancewith Section 2.4.17, Appeal.(1) CharacteristicsThe Agriculture/Horticulture Use Category is characterized by generalagricultural activities, including the cultivation and production of orchard,garden, or nursery crops on a small or large scale, the production of fieldgrown crops, specialty crops, flowers, fruit, grapes, market gardening, nurserystock, nuts, ornamental plants, sod, vegetables, and similar horticultural uses.The use category also includes agronomy, aquaculture, biotechnical agriculture(including education parks for biotechnical agriculture or a demonstrationfarm), fisheries, honey production, and similar uses. Accessory uses mayinclude offices, storage areas and repair facilities related to agriculture uses.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE10.18
