Chapter 5: <strong>Development</strong> StandardsSECTION 5.8: NONRESIDENTIAL DESIGN STANDARDSSubsection 5.8.2: Applicability5.8.2. ApplicabilityA. General(1) Unless exempted in accordance with Section 5.8.2.D, Exemptions, thestandards in this section shall apply to all new nonresidential and mixed-usedevelopment.(2) Large retail development shall comply with the Nonresidential DesignStandards in Section 5.8.3 as well as the Large Retail Design Standards inSection 5.8.4. In the event of conflict, the standards in Section 5.8.4, LargeRetail Design Standards, shall control.B. Timing of ReviewReview of proposed development to ensure compliance with the standards of thissection shall occur at time of site plan (Section 2.4.7), planned development masterplan (Section 2.4.5), or zoning compliance permit (Section 2.4.9), as appropriate.C. Existing <strong>Development</strong> and Redevelopment<strong>Development</strong> existing prior to January 1, 2013 as well as redevelopment of buildingsestablished before January 1, 2013 are encouraged to, but not required to, complywith these standards.D. ExemptionsIndustrial development, and development subject to the standards in Section 5.9,Shopping Center Design Standards, shall be exempted from the standards of thissection.E. Community Compatibility StandardsNonresidential development located adjacent to single-family detached developmentshall also be subject to the community compatibility standards in Section 5.10.5.8.3. Nonresidential Design StandardsAll commercial, office, and mixed-use development subject to this section shall comply withthe following standards:A. Access and Circulation(1) Off-Street Parking Location(a)CC and VC DistrictsSingle-story commercial, office, and mixed-use development in the CCand VC districts shall be configured to locate all required surface offstreetparking to the side or rear of the building. Buildings of two ormore stories may locate up to two rows of off-street parking betweenthe primary entrance and the street it faces. In no instance shall morethan two rows of off-street parking be located between the buildingand the street it faces (see Figure 5.8.3.A, Parking Location).CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE5.61
