Height StandardsAll fences and walls shall conform to the standards in Table 5.3.4, Fence and Wall Height. Exemption for Security PlanA landowner or tenant or a representative of a public agency responsible for a governmentfacility, public safety use, utility, or other use in need of heightened security may submit to thePlanning Director a site security plan proposing a fence or wall taller than those permitted bythis section or proposing the use of barbed, concertina, or electric wire atop a fence or wallfor security reasons. The Planning Director shall approve, or approve with conditions, the sitesecurity plan and its proposed exemption of fences or walls from the standards of this section,upon finding:A. Need for Safety or Security ReasonsThe condition, location, or use of the land, or the history of activity in the area,indicates the land or any materials stored or used on it are in significantly greaterdanger of theft or damage than surrounding land, or represents a significant hazard topublic safety without:(1) A taller fence or wall;(2) An electric fence; or(3) Use of barbed or concertina wire atop a fence or wall.B. No Adverse EffectThe proposed fence or wall configuration will not have a significant adverse effect onthe security, functioning, appearance, or value of adjacent properties or thesurrounding area as a whole.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE5.37
