Chapter 10: Definitions and MeasurementSECTION 10.5: DEFINITIONSRegulatory flood protection evevation (rfpe)REGULATORY FLOOD PROTECTION EVEVATION (RFPE)The base flood elevation plus freeboard. In special flood hazard areas where base floodelevations have been determined, this elevation shall be the base flood elevation plus one footof freeboard. In special flood hazard areas where no base flood elevation has been established,this elevation shall be at least two feet above the highest adjacent grade.RELIGIOUS INSTITUTIONA structure or place in which worship, ceremonies, rituals, and education are held, togetherwith its accessory buildings and uses (including buildings used for educational and recreationalactivities), operated, maintained, and controlled under the direction of a religious group.Religious institutions include churches, mosques, synagogues, and temples. Accessory usesmay include school facilities, parking, caretaker's housing, pastor's housing, and group livingfacilities such as convents.REMEDY A VIOLATIONFor the purposes of Section 7.4, Flood Damage Prevention, to bring the structure or otherdevelopment into compliance with State and community floodplain management regulations,or, if this is not possible, to reduce the impacts of its noncompliance. Ways that impacts maybe reduced include protecting the structure or other affected development from flooddamages, implementing the enforcement provisions of the ordinance or otherwise deterringfuture similar violations, or reducing Federal financial exposure with regard to the structure orother development.REPAIR ESTABLISHMENTAn establishment primarily engaged in the provision of repair services for TV’s, bicycles,clocks, watches, shoes, guns, canvas products, appliances, and office equipment; includingtailor; locksmith; and upholsterer. Repair establishments do not include outdoor storage ofgoods, materials, or equipment.RESEARCH AND DEVELOPMENTA business that engages in research, or research and development, of innovative ideas intechnology-intensive fields. Examples include research and development of computersoftware, information systems, communication systems, transportation, geographic informationsystems, multi-media and video technology. <strong>Development</strong> and construction of prototypes maybe associated with this use.RESTAURANT, WITH INDOOR AND OUTDOOR SEATING ONLYAn establishment where meals or prepared food, including beverages and confections, areserved to customers for consumption on the premises. Such a facility may include indoor andoutdoor seating, but no drive-through service.RETAIL SALES ESTABLISHMENTCommercial enterprises that provide goods and/or services directly to the consumer, wheresuch goods are available for immediate purchase and removal from the premises by thepurchaser. Examples include stores selling, leasing, or renting consumer, home, and businessgoods such as art, art supplies, bicycles, cameras, clothing, dry goods, electronic equipment,fabric, furniture, garden supplies, gifts, groceries and food sales, hardware, homeimprovements, household products, jewelry, pets, pet food, pharmaceuticals, plants, printedmaterial, stationary, and videos.RIGHT OF WAYAn area of land not on a lot (or part of a minimum lot area) that is dedicated for public orprivate use to accommodate a transportation system and necessary public or private utilityinfrastructure (including but not limited to roads, water lines, sewer lines, power lines, and gasCURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE10.76
