Chapter 10: Definitions and MeasurementSECTION 10.5: DEFINITIONSSubstantial ImprovementSUBSTANTIAL IMPROVEMENTAny repair, reconstruction, expansion, or improvement of a structure, the cost of whichexceeds 50 percent of the assessed value of a structure as determined either before theexpansion or improvement begins or before the damage occurred giving rise to the repair orreconstruction. Substantial improvement shall not include, however any repair orimprovement required bringing the structure into compliance with existing state or countyhealth, sanitary, safety, or building <strong>Ordinance</strong> specifications necessary to ensure safe habitationof the structure.For the purposes of Section 7.4, Flood Damage Prevention, any combination of repairs,reconstruction, rehabilitation, addition, or other improvement of a structure, taking placeduring any five-year period for which the cost equals or exceeds 50 percent of the marketvalue of the structure before the “start of construction” of the improvement. This termincludes structures which have incurred “substantial damage”, regardless of the actual repairwork performed. The term does not, however, include either:(a) any correction of existing violations of State or community health, sanitary, or safetycode specifications which have been identified by the community code enforcementofficial and which are the minimum necessary to assure safe living conditions; or(b) any alteration of a historic structure, provided that the alteration will not preclude thestructure's continued designation as a historic structure.SUSTAINABLE DEVELOPMENT<strong>Development</strong> that meets the needs of the present without compromising the ability of futuregenerations to meet their own needs.SUSTAINABLE DEVELOPMENT PRACTICESOne or more development features voluntarily provided by an applicant or developer as ameans of promoting sustianbale development and/or taking advantage of available sustainabledevelopment practice incentives.SWALEA depression in the land that collects stormwater runoff and conveys it to another location.SWIMMING POOLAn above- or below-ground structure that is filled with water and used for swimming.TATTOO PARLORAn establishment whose principle business activity, either in terms of operation or as held outto the public, is the practice of one or more of the following: (1) placing of designs, letters,figures, symbols, or other marks upon or under the skin of any person, using ink or othersubstances that result in the permanent coloration of the skin by means of the use of needlesor other instruments designed to contact or puncture the skin.TAXICAB SERVICETransport by vehicle (ex. taxi, limousine) for a single passenger or small group of passengersbetween locations of their choice.TECHNICAL REVIEW COMMITTEEA group of county staff and governmental agencies who review and approve site plans, sketchplans, and construction drawings for subdivisions.CURRITUCK COUNTY, NC UNIFIED DEVELOPMENT ORDINANCE10.85
