Las Uniones extramatrimoniales ante la falta <strong>de</strong> conubium:<br />

Fundamento jurídico <strong>de</strong> los impedimentos matrimoniales en la Roma clásica<br />

histórico surgieron cada una <strong>de</strong> ellas 126 . Siguiendo a la<br />

doctrina 127 , examinamos cada una <strong>de</strong> ellas para compren<strong>de</strong>r el<br />

alcance jurídico y los efectos que producían en el Derecho<br />

De esta manera lo expresa P. Corbett, al reparar en las fuentes que<br />

regulan las formas <strong>de</strong>l matrimonio, cuando literalmente señala que:<br />

"From the legal point of view, marriage in the classical period of<br />

Roman law is almost, if not entirely, a formless transaction. That is<br />

sufficient explanation of the fact that so little is to be found in<br />

the juristic writings on the subject of forms (…). It is now generally<br />

assumed, and on good grounds, that the original Roman marriage always<br />

involved manus over the wife, while the marriage without manus, the<br />

so-called free marriage, was of comparatively late <strong>de</strong>velopment (…). Of<br />

these the best account, brief as it is, is that given by Gaius in I,<br />

III-II3. Three institutions are there <strong>de</strong>scribed in the following<br />

or<strong>de</strong>r, usus, confarreatio, and coemptio. Nothing is said there, or<br />

elsewhere in the Roman records, as to the comparative antiquity of<br />

these forms, and there is no reason for supposing that Gaius treats<br />

them in chronological or<strong>de</strong>r. Only one indication as to age is given<br />

that is the statement that the XII Tables provi<strong>de</strong>d for the<br />

interruption of usus by trinoctio abesse".<br />
