RESUMEN El <strong>de</strong>recho <strong>de</strong> libertad sindical <strong>de</strong> los funcionarios públicos se regula en la Ley Orgánica<br />

11/1985, <strong>de</strong> 2 <strong>de</strong> agosto, <strong>de</strong> Libertad Sindical. No obstante, esta disposición legal, en cumplimiento<br />

<strong><strong>de</strong>l</strong> doble mandato establecido en los arts. 28.1 y 103.3 <strong>de</strong> la Constitución Española,<br />

establece <strong>de</strong>terminadas peculiarida<strong>de</strong>s propias <strong>de</strong> la libertad sindical <strong>de</strong> los funcionarios<br />

públicos, al tiempo que se remite en cuanto al ejercicio <strong>de</strong> la actividad sindical colectiva<br />

«a los términos previstos en las normas correspondientes», <strong>de</strong> suerte que serán éstas<br />

últimas las que establezcan las condiciones <strong>de</strong> su ejercicio. En este contexto se sitúa el presente<br />

estudio en el que se analiza la inci<strong>de</strong>ncia <strong>de</strong> la regulación <strong><strong>de</strong>l</strong> Estatuto Básico <strong><strong>de</strong>l</strong><br />

Empleado Público sobre el <strong>de</strong>recho <strong>de</strong> libertad sindical <strong>de</strong> los funcionarios públicos, particularmente<br />

sobre la representatividad sindical, la representación sindical (las secciones y<br />

<strong><strong>de</strong>l</strong>egados sindicales), y los <strong>de</strong>rechos <strong>de</strong> los cargos electos sindicales.<br />

ABSTRACT The freedom of association right of public servants is regulated by the Organic Law<br />

11/1985, of 2nd August, on the Right to Establish Tra<strong>de</strong> Unions. However, this legal provision,<br />

in accordance to the double-hatting formula established by articles 28.1 and 103.3<br />

of the Spanish Constitution, establishes certain peculiarities with regards to the freedom<br />

of association of civil servants. At the same time, as per the exercise of the collective tra<strong>de</strong><br />

union activity, the legal provision refers to «the terms established in relevant rules», so it<br />

will be these rules that will <strong>de</strong>fine the conditions governing the exercise of such right.<br />

Within this context, this paper analyses how the Basic Statute of Public Employees<br />

affects the public servants' freedom of association right, particularly as it regards tra<strong>de</strong><br />

union representativeness, tra<strong>de</strong> union representation (tra<strong>de</strong> union sections and representatives)<br />

and the rights of tra<strong>de</strong> union elected representatives.<br />
