Presentation The First International Congress on Constitutional Law and Political Philosophy, organized by the Centre of Graduate Research Studies in Law of the UFMG (Federal University of Minas Gerais) and the Centre of Graduate Research Studies in the Dom Helder School of Law, has as central theme “On the Future of Constitutionalism and the Democratization of Constitutional Law”. The event is part of the internationalization plans of the Centre of Graduate Research Studies in Law of the UFMG and of the Centre of Graduate Research Studies in Law of the Dom Helder School of Law. It aims to reflect in a critical way about the systems of judicial review found in Comparative Law and to analyze the moral and political foundations of judicial review. The background of the event is constituted by the critics to constitutional adjudication raised by legal and political philosophers such as Jeremy Waldron, Mark Tushnet and Richard Bellamy, who challenge the legitimacy of constitutional courts and no longer support the liberal assumption that these courts are a special forum for deliberation about moral issues and principled arguments. We intend to examine, in the Congress, the arguments found in contemporary legal and political philosophy to establish a deliberative ethics for constitutional courts and for the development of institutional and political reforms with a view to redefining the role and the configuration of constitutional courts. In this context, the contributions of the Keynote Speakers aim to define a sort of an ideal-type for the equilibrium and the cooperation of powers, with the aim of legitimizing the discourse about rights. We will analyze, furthermore, some models recently adopted by foreign legal systems, the experience of which can be a reasonable indicator to assess ongoing proposals to “weaken” the Brazilian system of judicial review, in order to enhance the “institutional dialogue” with the legislature.
