Juridical Status of Minority Languages in some Border Areas Giovanni Poggeschi, European Academy Bolzano/Bozen, gpoggeschi@eurac.edu Abstract The languages of border areas are often a very sensitive issue, especially in the case of minority languages. This paper explores the juridical situation of four border areas of Europe: South Tyrol, Navarra, Alsace and Thrace. The analysis is juridical, and respects the hierarchy of the sources of the law: Constitution, State ordinary legislation and regional legislation, if it exists. The analysis focuses on the minority protection through the linguistic rights that in the last decades have been increasingly recognized in Europe, also through the policy of the European Union. 1. Introduction This paper 1 tackles the juridical situation of minority languages in some border areas in Europe: South Tyrol, Navarra, Alsace and Thrace. I will treat the subject from the juridical point of view, but I am glad to be in a “linguist arena” which allows me to take into consideration some sociolinguistic and historical issues. I apologise in advance if I will not be very technical in some issues which are not purely juridical, but I am aware that everything that is related to the linguistic minority issues has to be understood not only from a juridical perspective. I will begin by briefl y describing the Constitutional status of (minority) languages in the States of reference: Italy, Spain, France and Greece. Then, I will get down to the regional/ local dimension and explore whether and how the sub-state legislation is able to regulate the protection and the promotion of linguistic minorities. Finally, I will focus on the distinctiveness of the border regions, trying to fi gure out how the geographical location affects the status of those languages. Being a comparatist, I will often make references to other juridical systems in order to support my thesis. 2. The increasing importance of the legislation on the linguistic minority issue The importance of the issues regarding languages and minorities has been growing constantly over the last decades in the juridical systems of Europe and more generally in all the fi ve continents. The reason for this burgeoning lies in the expansion of the idea of equality and in its follow-up. The liberal Constitutions tended to take the homogenous character of the State for granted, with very few exceptions, e.g. Switzerland. The link between Nationalism and the lack of Minority Protection has been underlined by many authors (Carrozza 1995), like the link between the Geist of a Nation and its Constitution: the former legitimates the latter (Schmitt 1928: 112-117). This is not the place to develop such an analysis, but it is important to underline the fact that the political climate during the rise of constitutionalism at the end of 19th century and during the fi rst half of the 20th century was not particularly good for the protection of linguistic minorities.
