O presente artigo apresenta uma discussão sobre a escassez da água em termos qualitativos e quantitativos,
apontando a poluição como uma das principais causas que interferem na sua qualidade. Na sequência é realizado
um estudo comparativo entre a legislação brasileira e a alemã sobre a cobrança pela poluição da água nos
dois países. A metodologia utilizada será a comparativa, utilizando-se ainda o método dedutivo. O enfoque principal
será descobrir o modo como os dois Estados tratam questão da poluição da água e qual punição dispensam
aos infratores. Na Alemanha há a cobrança pela poluição da água. O valor depende da quantidade de resíduos e
do quanto eles causaram de dano. No Brasil, apesar de mais dispositivos sobre o assunto, a cobrança acaba não
acontecendo. Existem projetos de Educação Ambiental em algumas instituições, porém ainda são ações isoladas.
Consequentemente, a consciência de que é preciso cuidado também não é tão forte. Na Alemanha existem
projetos de Educação Ambiental que envolvem a população desde os três anos de idade. Existe a preocupação
em formar no cidadão, a consciência da importância da proteção ambiental. A fiscalização do Poder Público é
forte, sendo aplicadas multas para o poluidor. Para que a água esteja disponível para as próximas gerações, é
urgente a implantação de soluções apontando alternativas uma vez que a sobrevivência de todos depende dela.

ABSTRACT
The following article presents a discussion about the lack of water in qualitative and quantitative terms, pointing
out pollution as one of the main things that interfere on its quality. Then, there is a comparative study between
Brazilian and German law (legislation) concerning water pollution charging in both countries. Comparison is the
aplyied methodology, including deduction. The main focus is to find out how do the two countries deal with
water pollution issue and what is the punishment applied to offenders. In Germany there is a charge on water
pollution. The amount depends on the quantity of waste and on how much damage they have caused. In Brazil,
although having more provisions about it, charging ends up not happening. There are projects about Environmental
Education in some institutions but they are still isolated actions. Thereafter, counsciousness that taking care
of water is not strong either. In Germany, there are Environmental Education projects that engage people since
three years old. There is a concern on developing on people a sense about the importance of environmental
saving. Governmental Inspection is strong and fine is applied to the polluter. So that water is available for future
generations , it is urgent deployment of solutions aiming alternatives since the survival of all depends on it.
