that the second wave of refugees is facing.<br />

In 2004, the refugee legislation suffered the most important<br />

changes regarding immigration to Romania. One of the<br />

most important changes was the application of the first integration<br />

program for refugees in Romania. But despite the<br />

existence of the integration program, there are still many<br />

visible inconsistencies between the integration program itself<br />

and its actual implementation. This is also recognized by<br />

the European Commission against Racism and Intolerance<br />

(2006:24) which argues that in Romania“ problems nevertheless<br />

remain in terms of the legislation on asylum seekers<br />

and refugees and its application (…) much remaining to be<br />

done to ensure that the legislation concerning refugees and<br />

asylum seekers is applied 181 “ (2006:24).<br />

The Commission mentions that only 4% of asylum seekers<br />

obtain refugee status and that 60% of them leave Romania<br />

„because they are unable to integrate“. The main<br />

obstacles to the integration mentioned by the Commission<br />

are: unattainable process of their diploma recognition, hardship<br />

in finding work and integrate in the labor market. Regarding<br />

their economic integration, it must be noted that<br />

besides the impossibility of their diploma recognition which<br />

automatically leads to impossibility to find work, the responsible<br />

authorities are not aware of the present legislation<br />

which applies to refugees: „National Employment Agency<br />

does not cater to refugees because it is not aware of the<br />

relevant law or of refugees’ needs and lacks the resources<br />

to remedy these deficiencies“ (ECRI, 2006:24, in Refugee<br />

Documentation Centre of Ireland, 2010:3) 182 .<br />

Still, the integration of the refugees in Romania registered<br />

many positive changes together with the legislation<br />

regarding the residence of the foreigners in Romania. According<br />

to the MIPEX study (2011) even if the immigrants<br />
