The Machine and Copyrights
The simple complexity of machine translation
Issues addressed in the presentation are the impact of copyright laws
when a text is translated using software in the form of

Machine Translation such as offered online for free by Google or
other commercial Machine Translation products;
−−
using a Translation Memory or
−−
using and creating a Terminology Database from third party texts.
Important aspects also covered are what role does copyright law play
in the creation of a Translation Memory and of a Terminology Database
using third party texts. Does the claim of “fair use” under US law offer
any protection for those who use third party texts? And why does
it have no legal effect at all for texts originating in EU member states?
What does “work for hire” mean in translation contracts and what role
do contracts play when determining who owns a translation?
The presentation examines these issues of copyright law and translations
using software under English, US and German law.
Die Maschine und das Recht
Die schlichte Komplexität des Urheberrechts bei maschineller Übersetzung
Der Vortrag befasst sich damit, was mit Urheberrechten passiert, wenn
ein Text mit Unterstützung von Software übersetzt wird. Dabei wird
genauer untersucht, welche Folgen die Nutzung hat von
−−
maschineller Übersetzung zum Beispiel von Google oder von anderen
Anbietern;
−−
Translation-Memory-Software;
−−
Terminologie-Datenbank.
Weitere Aspekte des Vortrages sind, welche Rolle das Urheberrecht bei
der Erstellung einer Translation-Memory- und einer Terminologie-Datenbank
spielt, wenn die Texte Dritter verwendet werden. Es wird auch
erläutert, welche Bedeutung Komponenten des US-Urheberrechts in
der EU haben, vor allem die Behauptung des „fair use“ und die Verwendung
des Begriffs „work for hire“ in Verträgen werden näher untersucht
und erklärt. Der Vortrag bezieht das US, englische und deutsche Urheberrecht
ein.
