20.7.5. Regulatory Compliance<br />

Development of a HLW repository is a long‐last<strong>in</strong>g process. There is a need for<br />

regulatory control even <strong>in</strong> the early phases of this process. The regulatory <strong>in</strong>struments<br />

available for this control are, generally speak<strong>in</strong>g, i) report<strong>in</strong>g obligations, ii) issuance of<br />

regulations and guidance, and iii) licens<strong>in</strong>g obligations.<br />

In the early research and development phase, the emphasis of regulatory control lies <strong>in</strong><br />

sett<strong>in</strong>g report<strong>in</strong>g obligations and <strong>in</strong> giv<strong>in</strong>g “feedback” to the implementer on the basis of<br />

the regulatory review of the reports. This report<strong>in</strong>g‐review may occur regularly (e.g., the<br />

review of the R&D program <strong>in</strong> Sweden is every three years) or it may be scheduled at<br />

certa<strong>in</strong> milestones <strong>in</strong> the repository development program.<br />

Issuance of regulations and regulatory guidance is an important part of the dialogue<br />

between regulator and implementer, enhanc<strong>in</strong>g its public credibility. Formulation of<br />

regulatory documents should be made <strong>in</strong> a stepwise manner, start<strong>in</strong>g from general<br />

pr<strong>in</strong>ciples and non‐prescriptive criteria and end<strong>in</strong>g with safety requirements applicable to<br />

a licens<strong>in</strong>g review. The regulatory endpo<strong>in</strong>ts, such as dose constra<strong>in</strong>ts or risk targets, are<br />

normally def<strong>in</strong>ed <strong>in</strong> mandatory regulations. Regulatory guidance is needed to clarify how<br />

compliance with these endpo<strong>in</strong>ts should be demonstrated.<br />

Because spent fuel and high‐level waste disposal issues raise worldwide <strong>in</strong>terest,<br />

<strong>in</strong>ternational consistency <strong>in</strong> regulations and regulatory guidance is desirable. International<br />
