3. <strong>Basic</strong> Pr<strong>in</strong>ciples Of Nuclear Safety<br />

(4) To provide the regulatory body with adequate authority and power, and ensure that<br />

it has adequate staff<strong>in</strong>g and f<strong>in</strong>ancial resources to discharge its assigned<br />

responsibilities;<br />

(5) To ensure that no other responsibility is assigned to the regulatory body which may<br />

jeopardize or conflict with its responsibility for regulat<strong>in</strong>g safety;<br />

(6) To ensure that adequate arrangements are made for decommission<strong>in</strong>g, closeout or<br />

closure, site rehabilitation, and the safe management of spent fuel and radioactive<br />

waste;<br />

(7) To ensure that adequate arrangements are made for the safe transport of radioactive<br />

material;<br />

(8) To establish an effective system of governmental emergency response and<br />

<strong>in</strong>tervention capabilities and to ensure emergency preparedness;<br />

(9) To ensure the adequacy of physical protection arrangements where they <strong>in</strong>fluence<br />

safety;<br />

(10) To provide for adequate f<strong>in</strong>ancial <strong>in</strong>demnification arrangements for third parties <strong>in</strong><br />

the event of a nuclear or radiation accident <strong>in</strong> view of the potential damage and<br />

<strong>in</strong>jury which may arise from an accident; and<br />

(11) To provide for the technological <strong>in</strong>frastructure necessary to support the safety of<br />

facilities and activities, where these are not provided by other organizations.<br />

The prime responsibility for safety shall be assigned to the operator. The operators shall<br />

have the responsibility for ensur<strong>in</strong>g safety <strong>in</strong> the sit<strong>in</strong>g, design, construction,<br />

commission<strong>in</strong>g, operation and decommission<strong>in</strong>g, closeout or closure of their facilities,<br />

<strong>in</strong>clud<strong>in</strong>g, as appropriate, rehabilitation of contam<strong>in</strong>ated areas, and for activities us<strong>in</strong>g,<br />

transport<strong>in</strong>g or handl<strong>in</strong>g radioactive material. Organizations that generate radioactive<br />

waste shall have the responsibility for the safe management of the radioactive waste that<br />

they produce. S<strong>in</strong>ce dur<strong>in</strong>g the transport of radioactive material, primary reliance for
